TARGET GROUP

This programme is suitable for career-oriented individuals including Senior High School Leavers and matured corporate/business personnel who desire to pursue courses and upgrade their careers in various specialised areas in the real estate industry, including property management, facilities management, land administration/management, and real estate agency practice.

Course objective

Real estate agency is one of the most well-known and lucrative sectors of the real estate industry. It is the sector that helps to keep the real estate market active and buoyant, making land in various locations available for development, as well as providing various kinds of housing, offices and warehouse accommodation to prospective purchasers and lessees. This sector, unfortunately, has been subjected to abuse and loss of public confidence over the years due to the dominance of untrained and fraudulent operatives in the business, coupled with the fact that the practice has, until recently, not had any legal backing by way of an enabling legislation . There is, therefore, a clear need for formal education and training for people who genuinely aspire to pursue a career in the business of real estate agency.

Also, with the recent enactment of the Real Estate Agency Act, 2020 (Act 1047) with the objective of regulating real estate agency practice in the country, there is a statutory requirement for aspiring estate agents to be licensed by the Real Estate Agency Council after passing the Councils examinations. Our certificate programme adequately prepares the learner to acquire the knowledge and skills that will enable him/her to successfully acquire the licence to operate legally as an estate agent.

To be a successful estate agency practitioner, one requires two related sets of knowledge – management of an estate agency business, and acquiring and implementing skills in the actual estate agency practice. The training programme therefore covers key activities and the underlying principles constituting the operations of an estate agent as well as the management of such a business. The course also treats in considerable detail analysis of the new Real Estate Agency Law as well as elements of land law that have relevance to estate agency practice.

CERTIFICATE IN REAL ESTATE AGENCY - Course Outline

i. Definition and Principles of Estate Agency practice

ii. Professional Ethics and General Rules of Conduct in Real Estate Agency business, and Disciplinary Measures against breaching established standards and code of conduct/ethics.

iii. Analysis and interpretation of the relevant elements of the Real Estate Agency Act, 2020 (Act 1047). The need for Estate Agents to familiarise themselves with the following key provisions of the Act:

  • Role of the Estate Agency Council to the estate agency business
  • Registration and Licensing of Estate Agents as a pre-condition for practising
  • The Sales/Purchase Agreement
  • The Clients’ Account and the modes of payment for real estate transactions
  • Accounting and Auditing of the Real Estate Agency Firm
  • Records of operation to be kept by Estate Agent including Annual Reports
  • Application of Anti-Money Laundering Act, 2020 (Act 1044) to Estate Agency practice.

iv. Statutory control over Estate Agency Practice: Overview of how the combined effects of the Common law and Ghana’s Real Estate Agency legislation govern the rights and duties of an Estate Agent.

v. The establishment, operating, managing, and termination of an Estate Agency business.

vi. Agent/Principal relationship – Types of Mandates and the procedure for obtaining Mandates.

vii. Relationship between an Estate Agent and Third Party

    • Advertising, Promotion, and Listing of available spaces

LEARNING OUTCOMES

At the end of the course programme, trainees/learners would have acquired the fundamental knowledge and in-depth understanding of the various facets of real estate agency practice. Learners will have clear theoretical and practical knowledge of:
Managing an estate agency business and marketing its services to property-owners and prospective buyers and lessees.
Marketing all types of property through effective promotion and advertising, property inspection and reporting, site assembly, sourcing potential buyers, sellers, landlords, and lessees, as well as liaising effectively with mortgage lenders to secure finance for property purchases on behalf of clients.
Offering strategic advice on property prices, availability and suitability of property types as investment opportunities, suitable site locations, etc.
Providing basic property administration services including sale and lease documentation, market analysis for land and property pricing, lease structuring, and supervising custodian services in various premises.
The legal framework guiding estate agency practice.
